1. ACCEPTANCE OF THESE TERMS

These Terms and Conditions govern your access to and use of www.peaktheory.co.za (“Website”) and any purchase made from Peak Theory.

By accessing the Website, creating an account, submitting an order, purchasing a product or accepting these Terms during checkout, you acknowledge that you have read, understood and agreed to be bound by them.

If you do not agree with these Terms, you must not place an order.

These Terms should be read together with Peak Theory’s Privacy Policy, Returns and Refund Policy, Delivery Policy and any product-specific notices displayed on the Website.

Nothing in these Terms is intended to exclude any right that cannot lawfully be excluded under applicable South African law.

2. AGE RESTRICTION

By placing an order, you represent and warrant that:

3. RESEARCH USE ONLY

All products supplied by Peak Theory are offered strictly for lawful research, laboratory or analytical purposes only.

Products are not supplied for:

3. human or animal administration;
4. injection;
5. ingestion;
6. topical human or animal application;
7. self-experimentation;
8. therapeutic use;
9. diagnostic use;
10. treatment or prevention of disease;
11. weight-loss or weight-management treatment;
12. bodybuilding or performance enhancement;
13. cosmetic treatment;
14. anti-ageing treatment;
15. veterinary use; or
16. any other use inconsistent with the research-only purpose for which the product is supplied.

The presence of a product name, chemical name, molecular description, scientific reference, research article, analytical result or other scientific information on the Website does not change the purpose for which the product is offered.

4. NOT FOR HUMAN OR ANIMAL USE

Products supplied by Peak Theory must not be consumed, ingested, injected, administered, applied or otherwise introduced into the body of any human or animal.

Products must not be reconstituted, compounded, mixed, prepared, altered or otherwise manipulated for the purpose of administration to a human or animal.

Products must not be supplied, transferred or resold to another person for any such purpose.

Any purchaser who uses or supplies a product contrary to this section acts outside the purpose for which the product was supplied and in breach of these Terms.

5. NO MEDICAL OR TREATMENT ADVICE

Peak Theory does not provide medical advice.

Nothing contained on the Website, product pages, research articles, FAQs, social-media accounts, emails, messages, packaging, laboratory reports, Certificates of Analysis or other communications from Peak Theory constitutes or should be interpreted as:

1. medical advice;
2. pharmaceutical advice;
3. prescribing advice;
4. dosage advice;
5. injection instructions;
6. administration instructions;
7. treatment recommendations;
8. diagnosis; or
9. therapeutic recommendations.

Peak Theory does not provide instructions regarding human or animal dosage, administration, injection, treatment protocols or personal medical use.

Any scientific or educational information provided by Peak Theory is supplied solely for general informational or research-context purposes.

6. PRODUCT STATUS AND REPRESENTATIONS

Products offered by Peak Theory are supplied solely for the research, laboratory or analytical purposes expressly stated on the Website.

Peak Theory reserves the right to restrict, suspend, discontinue or refuse the supply of any product where reasonably necessary for legal, regulatory, safety, operational or compliance purposes.

7. PURCHASER RESPONSIBILITIES

By purchasing from Peak Theory, you represent and warrant that:

1. you understand the research-only purpose of the products;
2. you will use products only for lawful research, laboratory or analytical purposes;
3. you will not use any product for human or animal consumption or administration;
4. you will not use any product for self-experimentation;
5. you will not provide a product to another person for prohibited use;
6. you will not represent a Peak Theory product as being intended or approved for therapeutic use;
7. you are responsible for the lawful possession, storage, handling and use of products purchased by you;
8. you have sufficient knowledge, facilities and competence to handle the products appropriately for their intended research purpose; and
9. information supplied by you concerning your order and intended purpose is truthful.

Peak Theory may request additional information concerning an order where reasonably necessary for safety, compliance, fraud prevention or verification purposes.

8. RIGHT TO REFUSE OR CANCEL AN ORDER

Peak Theory reserves the right, acting reasonably and lawfully, to refuse, suspend or cancel an order where:

1. a product is unavailable;
2. a material pricing or listing error has occurred;
3. payment has not cleared;
4. fraudulent or unauthorised payment is reasonably suspected;
5. false or misleading customer information has been supplied;
6. the purchaser does not satisfy the age requirement;
7. Peak Theory reasonably suspects that a product is intended for human or animal use;
8. customer communications indicate an intended prohibited use;
9. the transaction may be unlawful;
10. fulfilment may create a safety or compliance concern; or
11. circumstances outside Peak Theory’s reasonable control prevent fulfilment.

Where an order is cancelled after cleared payment has been received, any amount legally due to the customer will be refunded.

9. PRODUCT INFORMATION

Peak Theory takes reasonable measures to ensure that product descriptions, photographs, quantities and other product information appearing on the Website are accurate.

Product photographs may be illustrative unless expressly stated otherwise.

Research materials may display ordinary physical variations.

Differences in the physical appearance, density, colour, cake size, fill appearance or apparent volume of a product do not necessarily indicate differences in identity, purity or quantity.

Where analytical testing is available, the relevant analytical information should be considered when evaluating product specifications.

Nothing in this section limits statutory rights relating to materially incorrect descriptions or defective goods.

10. INDEPENDENT LABORATORY TESTING AND CERTIFICATES OF ANALYSIS

Peak Theory may make independent laboratory reports or Certificates of Analysis (“COAs”) available for certain products.

Where provided, analytical documentation relates to the sample or product identified in the relevant report and to the tests performed by the independent laboratory.

Independent laboratories operate separately from Peak Theory and remain responsible for their own testing procedures, analytical methods and reports.

Peak Theory does not represent independent laboratory testing as approval of a product for human or animal use.

Where Peak Theory provides access to an independent laboratory verification page, customers are encouraged to review the original report.

Peak Theory will not knowingly alter an independent laboratory result or knowingly represent a laboratory report as applying to a product to which it does not apply.

11. PRODUCT QUALITY

Peak Theory aims to supply research materials corresponding with the product description and specifications represented at the time of sale.

Unless expressly stated otherwise, Peak Theory does not warrant that a product is suitable for a particular experimental protocol or research application.

Research outcomes may depend upon factors outside Peak Theory’s control, including experimental methodology, equipment, environmental conditions, storage, handling, contamination and researcher competence.

Peak Theory therefore does not guarantee any particular experimental or research result.

Nothing in this section excludes any statutory product-quality right that cannot lawfully be excluded.

12. STORAGE AND HANDLING

Purchasers are responsible for appropriately storing and handling products after delivery.

Products must be kept secure and protected against:

1. unauthorised access;
2. access by children;
3. access by animals;
4. contamination;
5. accidental exposure;
6. incorrect identification or labelling;
7. misuse; and
8. inappropriate storage conditions.

Where Peak Theory provides product-specific storage information, customers should follow those recommendations together with appropriate laboratory practices.

Peak Theory cannot guarantee the condition of a product after it has been improperly stored, contaminated or mishandled after delivery.

13. ALTERATION OF PRODUCTS

Once a product has been opened, reconstituted, mixed, transferred, diluted, compounded, contaminated, altered, relabelled, repackaged or otherwise modified after delivery, Peak Theory cannot verify its subsequent condition, composition, purity, sterility or stability.

Any analytical documentation supplied with a product relates only to the material or sample represented by that documentation.

Modification of a product for human or animal administration is expressly prohibited.

14. PRICING

All prices displayed on the Website are in South African Rand (“ZAR”) unless otherwise indicated.

Peak Theory reserves the right to change prices prospectively without prior notice.

A price change will not ordinarily affect an order already accepted and paid for.

If an obvious pricing, typographical or technical error occurs, Peak Theory may correct the error and contact the customer before fulfilling the transaction.

Applicable consumer rights relating to displayed prices remain unaffected.

15. PAYMENT

Available payment methods will be displayed or communicated during checkout.

Where payment is made by Electronic Funds Transfer (“EFT”), submission of proof of payment does not itself constitute receipt of payment.

Payment is considered received once cleared funds reflect in the account nominated by Peak Theory.

Peak Theory may take reasonable measures to verify payment.

Orders associated with suspected fraudulent payments, stolen funds, unauthorised transactions or fraudulent proof of payment may be suspended or cancelled.

Where appropriate, suspected fraud may be reported to the relevant financial institution or authorities.

16. ORDER ACCEPTANCE

Submitting an order constitutes an offer by the customer to purchase the products listed in the order subject to these Terms.

An automated order acknowledgement does not necessarily constitute final acceptance of the order.

Peak Theory may verify payment, stock availability and compliance with these Terms before fulfilling an order.

Peak Theory reserves the right to reject an order in accordance with these Terms and applicable law.

17. STOCK AVAILABILITY

All products are subject to availability.

Peak Theory takes reasonable measures to maintain accurate stock information but cannot guarantee that every product displayed as available will remain available until an order is processed.

If Peak Theory cannot fulfil a paid order, the customer will be contacted and an appropriate remedy will be provided in accordance with applicable law.

18. DELIVERY

Available delivery options and applicable charges will be displayed or communicated during the ordering process.

Any delivery period provided is an estimate unless expressly guaranteed.

Delivery may be affected by courier operations, weather, infrastructure failures, strikes, public disturbances, supply-chain interruptions or circumstances outside Peak Theory’s reasonable control.

Customers are responsible for supplying a complete and accurate delivery address and correct contact information.

Where additional delivery costs arise solely because incorrect information was supplied by the customer, reasonable additional costs may be charged where legally permissible.

19. COURIERS

Peak Theory may use independent third-party courier companies to deliver orders.

Customers should inspect parcels as soon as reasonably possible after delivery and notify Peak Theory promptly if goods appear damaged, missing or incorrect.

Peak Theory may request photographs, packaging information or other reasonable evidence to investigate a delivery complaint.

Use of an independent courier does not remove any obligation imposed upon Peak Theory by applicable law.

20. RETURNS, CANCELLATIONS AND REFUNDS

Returns, cancellations and refunds are handled in accordance with Peak Theory’s Returns and Refund Policy and applicable South African consumer law.

Nothing in these Terms creates a blanket “all sales final” rule where applicable law gives a customer a right to cancel, return goods or receive a refund.

Products that have been opened, altered, reconstituted, mixed, contaminated, incorrectly stored or otherwise materially changed after delivery may not qualify for a voluntary return where they cannot reasonably and safely be returned to stock, subject to any statutory rights that remain applicable.

21. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

If a customer believes that they have received an incorrect, damaged or defective product, they should contact Peak Theory as soon as reasonably possible.

Peak Theory may request reasonable evidence necessary to investigate the complaint, including photographs, packaging information and relevant product information.

Where applicable law entitles the customer to a repair, replacement, refund or other remedy, Peak Theory will provide the remedy required by law.

22. PRODUCT SAFETY AND RECALLS

Peak Theory reserves the right to issue a product notice, withdrawal or recall where a material quality, labelling, analytical, safety or compliance concern is identified.

Customers receiving such a notice should follow the reasonable instructions contained in it.

Peak Theory may use information associated with an order to contact affected customers where reasonably necessary for product safety, quality control, recall or legal-compliance purposes.

23. RESEARCH RISKS

Research chemicals and laboratory materials may present hazards if stored, handled or used incorrectly.

Purchasers are responsible for following appropriate laboratory practices and determining the protective equipment, containment, storage, disposal and other safety measures suitable for their research.

Purchasers acknowledge that scientific research may involve inherent risks and that products must be handled by persons with appropriate knowledge and competence.

24. CUSTOMER MISUSE

Peak Theory supplies products solely for their expressly stated research purpose.

To the fullest extent permitted by law, Peak Theory will not be responsible for loss, damage or harm arising directly from a purchaser’s:

1. deliberate prohibited use;
2. human or animal administration;
3. use contrary to an express warning;
4. unlawful use;
5. unauthorised resale for prohibited use;
6. deliberate misrepresentation;
7. contamination after delivery;
8. improper storage after delivery;
9. alteration after delivery; or
10. use outside the stated research purpose,

except to the extent that such loss, damage or harm was caused by conduct for which Peak Theory remains legally responsible.

25. INDEMNITY FOR UNLAWFUL OR PROHIBITED CUSTOMER CONDUCT

To the maximum extent permitted by law, a purchaser who intentionally or unlawfully misuses, administers, resells, relabels, adulterates, modifies or represents a Peak Theory product contrary to these Terms agrees to indemnify Peak Theory against third-party claims directly arising from that purchaser’s unlawful or prohibited conduct.

This provision does not exclude liability that cannot lawfully be excluded.

26. LIMITATION OF LIABILITY

To the fullest extent permitted by South African law, Peak Theory will not be liable for indirect or consequential loss arising solely from:

1. circumstances outside Peak Theory’s reasonable control;
2. improper storage or handling after delivery;
3. unauthorised alteration of a product;
4. unlawful use;
5. use contrary to an express warning; or
6. use outside the product’s expressly stated research purpose.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

If any limitation contained in these Terms is legally ineffective, it will apply only to the maximum extent permitted by law.

27. NO GUARANTEE OF RESEARCH RESULTS

Scientific research inherently involves uncertainty.

Peak Theory does not guarantee that:

1. an experiment will succeed;
2. a product will produce a particular experimental result;
3. results obtained by one researcher will be reproduced by another;
4. findings reported in scientific literature will be reproduced in a particular experiment; or
5. a particular research methodology will produce an expected outcome.

Scientific references are provided for informational and research-context purposes only.

28. THIRD-PARTY INFORMATION AND LINKS

The Website may contain links to independent laboratories, scientific publications, courier companies, payment providers or other third-party websites.

Peak Theory does not control these third parties and is not responsible for their independent content, availability, policies or practices.

Where applicable law nevertheless requires Peak Theory to provide a refund or other remedy, this provision does not remove that obligation.

42. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Returns and Refund Policy, applicable Delivery Policy, product-specific notices and any additional terms expressly accepted during checkout, constitute the agreement governing the relevant Website transaction.

Nothing in this provision excludes rights or obligations that applicable law does not permit the parties to exclude.

43. PURCHASER’S FINAL DECLARATION

By placing an order with Peak Theory, the purchaser expressly confirms:

I WILL NOT PREPARE, RECONSTITUTE, MIX OR OTHERWISE MODIFY A PRODUCT FOR THE PURPOSE OF HUMAN OR ANIMAL ADMINISTRATION.

I WILL NOT SUPPLY A PRODUCT PURCHASED FROM PEAK THEORY TO ANOTHER PERSON FOR HUMAN OR ANIMAL USE.

I UNDERSTAND THAT PEAK THEORY DOES NOT PROVIDE MEDICAL, DOSAGE, INJECTION, ADMINISTRATION OR TREATMENT ADVICE.

I ACCEPT RESPONSIBILITY FOR ENSURING THAT MY PURCHASE, POSSESSION, STORAGE, HANDLING AND INTENDED RESEARCH USE COMPLY WITH THE REQUIREMENTS APPLICABLE TO ME.

I CONFIRM THAT THE PRODUCTS ARE BEING PURCHASED FOR THE PURPOSE FOR WHICH PEAK THEORY OFFERS THEM.

I HAVE READ, UNDERSTOOD AND ACCEPT THESE TERMS AND CONDITIONS.
