Delivery Policy

1. DELIVERY AREA

Peak Theory offers delivery to supported addresses within South Africa through independent third-party courier and logistics providers.

Delivery availability may depend upon the destination, courier coverage, accessibility and service availability.


2. DELIVERY PROVIDERS

Peak Theory may arrange deliveries using Bob Go and courier providers available or recommended through Bob Go.

Peak Theory may also use another reputable courier or logistics provider where reasonably appropriate for the destination, service availability, cost, delivery requirements or operational circumstances.

The courier used for a particular order may therefore vary.


3. DELIVERY FEES

Unless Peak Theory expressly offers free delivery on the applicable order, delivery charges are payable by the customer.

Orders over R2500 qualify for free standard delivery where the Website indicates that the promotion or delivery benefit applies.

Peak Theory reserves the right to amend its free-delivery threshold prospectively.

Additional delivery costs caused by circumstances attributable to the customer remain payable by the customer even where the original order qualified for free delivery.

These may include redelivery, address correction, return-to-sender or another delivery attempt.


4. PROCESSING AND DISPATCH

Peak Theory aims to process and dispatch paid orders as quickly as reasonably possible.

No specific dispatch time is guaranteed unless Peak Theory expressly confirms a guaranteed arrangement in writing.

Orders may require payment verification before dispatch.

Proof of payment does not constitute cleared payment.

Orders will ordinarily only proceed for fulfilment once payment has been verified or cleared to Peak Theory’s reasonable satisfaction.


5. DELIVERY TIMES

Delivery times displayed, estimated or communicated by Peak Theory or a courier are estimates unless expressly stated to be guaranteed.

Actual delivery time is affected by the independent courier and destination.

Delivery may be delayed by circumstances including:

  1. courier network congestion;
  2. unusually high parcel volumes;
  3. festive-season demand;
  4. public holidays;
  5. severe weather;
  6. road closures;
  7. protest action;
  8. national or regional strikes;
  9. civil unrest;
  10. infrastructure failure;
  11. vehicle breakdowns;
  12. accidents;
  13. hijacking, theft or criminal activity affecting courier operations;
  14. remote-area delivery schedules;
  15. operational disruption;
  16. natural disasters;
  17. governmental action; or
  18. other circumstances outside Peak Theory’s reasonable control.

Peak Theory cannot guarantee that an independent courier will deliver on a particular day or at a particular time unless such service has expressly been sold as a guaranteed service.

Peak Theory will nevertheless comply with delivery obligations imposed by applicable South African law.


6. CUSTOMER RESPONSIBILITY FOR DELIVERY INFORMATION

The customer is responsible for ensuring that all delivery information supplied during checkout is complete and accurate.

This includes:

  1. recipient name;
  2. delivery address;
  3. suburb;
  4. town or city;
  5. province;
  6. postal code;
  7. contact number;
  8. complex, estate, company or unit information where applicable; and
  9. any information reasonably necessary for the courier to access the delivery location.

Peak Theory is not responsible for delays or failed deliveries caused by incorrect, incomplete or outdated information supplied by the customer.


7. ADDRESS CHANGES AFTER DISPATCH

Customers should contact Peak Theory immediately if they discover an address error.

Peak Theory cannot guarantee that an address can be changed after an order has been handed to the courier.

Any additional courier fee resulting from an address change requested by the customer is payable by the customer.


8. UNAVAILABLE RECIPIENTS AND FAILED DELIVERY

The customer is responsible for ensuring that somebody is reasonably available to receive the parcel at the nominated delivery address where the courier requires receipt.

If delivery fails because:

  1. nobody is available;
  2. the recipient cannot be contacted;
  3. an incorrect contact number was supplied;
  4. access to the premises cannot be obtained;
  5. the customer refuses delivery without lawful justification;
  6. the customer fails to collect a parcel where collection is required; or
  7. incorrect or incomplete delivery information was supplied,

any additional delivery, redelivery, storage or return-to-sender costs may be charged to the customer.


9. RETURNED PARCELS

If a parcel is returned to Peak Theory because of circumstances attributable to the customer, including failure to receive or collect the parcel, the customer will be responsible for the cost of sending the parcel again.

This applies even where the original order qualified for free delivery.

Peak Theory may require the new delivery fee to be paid before redispatching the parcel.


10. COURIER DELAYS

Once a parcel has been handed to the courier, delivery is performed by an independent third-party delivery provider.

Peak Theory will reasonably assist customers with legitimate courier enquiries but does not control the courier’s vehicles, routes, staff, network or daily operations.

A delay by a courier does not automatically mean that the parcel is lost.

Where necessary, Peak Theory may request that the courier investigate the location or status of a shipment.


11. LOST PARCELS

A parcel will not ordinarily be treated as permanently lost merely because tracking has stopped updating or delivery is delayed.

Where a parcel appears to be lost, Peak Theory may first open or await the outcome of an investigation with the applicable courier.

Once the courier confirms that a parcel has been lost, or Peak Theory is otherwise reasonably satisfied that the parcel has been permanently lost in transit, Peak Theory will provide an appropriate replacement or refund.

Peak Theory may determine whether replacement or refund is appropriate subject to applicable consumer rights and the circumstances of the order.

The customer will not be charged a second delivery fee where the loss occurred while the parcel was in the courier network and was not caused by the customer.


12. DAMAGED PARCELS

Customers should inspect parcels promptly after delivery.

If a parcel or product arrives visibly damaged, the customer should preserve:

  1. the courier packaging;
  2. shipping label;
  3. internal packaging;
  4. affected product; and
  5. all contents received.

Customers should follow the damage-reporting requirements contained in Peak Theory’s Returns & Refund Policy.


13. TRACKING

Where tracking information is available, it may be provided to the customer.

Tracking information is generated or maintained by the courier and may occasionally be delayed, inaccurate or temporarily unavailable.

A lack of tracking movement does not by itself establish that a parcel has been lost.


14. OWNERSHIP AND RISK

Responsibility for goods during delivery will be determined in accordance with applicable South African law.

Nothing in this Delivery Policy transfers courier risk to a consumer where applicable law places that risk upon Peak Theory.

Once goods have been properly delivered to the customer or a person authorised to receive them, the customer becomes responsible for their subsequent storage, security and handling.


15. FORCE MAJEURE AND EVENTS OUTSIDE REASONABLE CONTROL

Peak Theory will not be responsible for delay caused solely by circumstances genuinely beyond its reasonable control to the extent permitted by law.

Peak Theory will nevertheless provide any refund, replacement or other remedy required by applicable South African law.
